Effective date: 13 May 2022
These Terms and Conditions govern your use of the Aquinas Life Coaching website and any coaching services, programs, resources, bookings, or communications offered by Aquinas Life Coaching. By accessing this website, booking a session, or using any of the services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the website or services.
1. Definitions
In these Terms and Conditions, “Aquinas Life Coaching”, “we”, “us”, and “our” refer to the owner and operator of Aquinas Life Coaching. “You” and “your” refer to any visitor, user, or client of the website or services. “Services” includes life coaching sessions, coaching packages, workshops, digital resources, and any related offerings made available through the website or by direct arrangement.
2. Nature of Coaching Services
Aquinas Life Coaching provides personal development and support services intended to help clients clarify goals, improve accountability, and build practical strategies for personal or professional growth. Coaching is not therapy, counselling, psychology, psychiatry, medical treatment, legal advice, financial advice, or any other regulated professional service. You remain responsible for your own decisions, actions, wellbeing, and results, and you should seek appropriately qualified professionals where needed.
3. Eligibility and Website Use
By using this website or booking services, you confirm that you are legally capable of entering into a binding agreement. You agree to use the website lawfully and not to misuse the website, attempt unauthorised access, interfere with its operation, upload harmful material, or use the content for unlawful or infringing purposes.
4. Bookings, Fees, and Payment
Session fees, package prices, and payment terms will be displayed on the website or otherwise communicated to you before you confirm a booking. Unless stated otherwise, all fees are quoted in South African Rand and are payable in advance of the scheduled service. A booking is only confirmed once payment has been received in cleared funds or where another written arrangement has been agreed. We reserve the right to change pricing at any time, but any confirmed booking will remain subject to the pricing communicated at the time of booking.
5. Cancellations, Rescheduling, and Refunds
If you need to cancel or reschedule a session, please provide at least 24 hours’ notice unless a different period is stated for a particular service or package. Sessions cancelled with less than the required notice, or missed without notice, may be forfeited or charged in full. Refunds are not guaranteed once a service has been booked or commenced, except where required by applicable law or where we expressly agree otherwise in writing. Where services are supplied through electronic transactions to consumers, any statutory rights that may apply under South African consumer law will continue to apply to the extent required by law.
6. Client Responsibilities
You agree to provide accurate information when making enquiries or bookings, to attend sessions on time, and to participate honestly and respectfully in the coaching process. You understand that coaching outcomes vary from person to person and depend significantly on your own commitment, follow-through, circumstances, and choices. You are solely responsible for evaluating and implementing any decisions or actions arising from coaching.
7. Health, Wellbeing, and Emergency Situations
Coaching is not designed to diagnose, treat, or manage mental health conditions, medical conditions, or crises. If you are in distress, at risk of harm, or require medical, psychological, psychiatric, or other urgent assistance, you should contact the appropriate emergency or professional support services immediately. We may decline, pause, or end services where we reasonably believe coaching is not appropriate for your circumstances.
8. Confidentiality
We will treat information shared during coaching with reasonable care and confidentiality. However, confidentiality may be limited where disclosure is required by law, where there is a serious risk of harm, where necessary to obtain professional advice, or where information is shared with trusted service providers for legitimate business administration and service delivery purposes subject to appropriate safeguards.
9. Privacy and Personal Information
We may collect and process personal information such as your name, contact details, booking information, payment-related information, correspondence, and any information you choose to provide in connection with the services. Personal information will be handled in accordance with applicable South African data protection law, including the Protection of Personal Information Act, and used for purposes such as responding to enquiries, managing bookings, delivering services, keeping records, communicating with you, and meeting legal or operational requirements. By using the website or services, you consent to such processing to the extent permitted by law. You may request access to, correction of, or deletion of your personal information, subject to legal limitations and record-keeping obligations.
10. Website Content and Intellectual Property
Unless otherwise stated, all content on this website, including text, branding, logos, course materials, downloads, graphics, and other materials, is owned by or licensed to Aquinas Life Coaching and is protected by applicable intellectual property laws. You may view and use the content for your personal, non-commercial use only. You may not copy, reproduce, distribute, publish, adapt, sell, or exploit any content without prior written permission, except to the extent allowed by law.
11. No Guarantees and Limitation of Liability
We aim to provide services with reasonable care and skill, but we do not guarantee specific outcomes, earnings, personal results, or business success from the use of the website or coaching services. To the maximum extent permitted by law, Aquinas Life Coaching will not be liable for any indirect, incidental, special, or consequential loss, or for any loss arising from decisions made or actions taken by you based on coaching or website content. Nothing in these Terms and Conditions excludes or limits any rights or remedies that cannot lawfully be excluded under applicable law.
12. Third-Party Tools and Links
The website may make use of third-party platforms or services for scheduling, payments, email communication, analytics, video meetings, or related functions. Such third-party services are subject to their own terms and privacy practices. We are not responsible for the content, availability, or practices of third-party services, except to the extent required by law.
13. Suspension and Termination
We reserve the right to refuse access to the website, decline bookings, suspend services, or terminate the coaching relationship where there is abusive behaviour, non-payment, misuse of the website, unlawful conduct, or any circumstance in which continuation is reasonably considered inappropriate. Any rights and obligations intended to survive termination will continue after termination.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. The latest version published on the website will apply from its stated effective date. Continued use of the website or services after any update constitutes acceptance of the revised Terms and Conditions.
15. Governing Law and Disputes
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute arising from or relating to the website or services will be subject to the jurisdiction of the South African courts, unless another dispute resolution process is required by law or agreed between the parties.
16. Contact Details and Statutory Information
